This Digital Millennium Copyright Act Policy (“DMCA Policy”) explains how we respond to claims of copyright infringement on our website (the “Website”). We respect the intellectual property rights of others and expect users of the Website to do the same.
1. What Is the DMCA?
The Digital Millennium Copyright Act (DMCA) is a United States copyright law that provides a process for copyright owners to request the removal of infringing content from online platforms. Even if you are located outside the United States, this policy outlines the process we follow to handle copyright complaints.
2. Reporting Copyright Infringement
If you believe that content published on this Website infringes your copyright, you may submit a written DMCA Takedown Notice to our designated agent (see Section 5).
Your Takedown Notice must include all of the following:
- Identification of the copyrighted work — a description of the original work you claim has been infringed (e.g., the original article, image, or video)
- Identification of the infringing content — the specific URL(s) on our Website where the allegedly infringing content appears
- Your contact information — your full name, mailing address, telephone number, and email address
- A statement of good faith — a statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
- A statement of accuracy — a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner’s behalf
- Your physical or electronic signature
Incomplete notices may not be processed. We are not responsible for any delays resulting from incomplete submissions.
3. Counter-Notice Procedure
If you believe that content you posted was removed by mistake or misidentification, you may submit a written Counter-Notice to our designated agent.
Your Counter-Notice must include:
- Identification of the removed content — a description of the content that was removed and the URL where it previously appeared
- Your contact information — your full name, mailing address, telephone number, and email address
- A statement under penalty of perjury — a statement that you have a good faith belief that the content was removed as a result of mistake or misidentification
- Consent to jurisdiction — a statement that you consent to the jurisdiction of the federal court in your district (or, if outside the United States, any judicial district in which the Website operator may be found), and that you will accept service of process from the person who submitted the original Takedown Notice
- Your physical or electronic signature
Upon receiving a valid Counter-Notice, we will forward it to the original complainant. If the complainant does not notify us within 14 business days that they have filed an action seeking a court order to restrain the alleged infringement, we may, at our discretion, restore the removed content.
4. Repeat Infringer Policy
In accordance with the DMCA and applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts or access of users who are deemed to be repeat infringers. We reserve the right to determine what constitutes a repeat infringement and to take appropriate action accordingly.
5. Designated DMCA Agent
All Takedown Notices and Counter-Notices must be sent to our designated DMCA agent at:
DMCA Agent: Rimwire Email: nunal0889@gmail.com
We strongly recommend submitting notices by email for faster processing. Please include “DMCA Takedown Notice” or “DMCA Counter-Notice” in the subject line.
6. Important Disclaimers
- Submitting a DMCA Takedown Notice is a legal action. Under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that content is infringing may be liable for damages, including costs and attorneys’ fees.
- We are not required to take action on notices that do not comply with the requirements of the DMCA.
- Removal of content pursuant to a Takedown Notice is not an admission of liability or wrongdoing on our part.
- We reserve the right to share Takedown Notices and Counter-Notices with third parties, such as the Lumen Database, for transparency purposes.
7. Fair Use Notice
This Website may reproduce, republish, or reference certain copyrighted material for the purposes of news reporting, commentary, criticism, and entertainment journalism. Such use may constitute fair use under Section 107 of the United States Copyright Act. We make this determination on a case-by-case basis.
If you believe a specific use does not qualify as fair use, please submit a Takedown Notice as described in Section 2.
8. Changes to This Policy
We reserve the right to update or modify this DMCA Policy at any time. Changes will be posted on this page with a revised “Last Updated” date. Your continued use of the Website after any changes constitutes your acceptance of the updated policy.
